Terms and Conditions

These terms and conditions (together with our Privacy Policy, and Website User Terms) set out the terms on which we provide you with the Bridaloop Service.

You should read these terms and conditions carefully and make sure that you understand them. By accessing and using the Website you agree to these terms and conditions.

You should print a copy of these terms and conditions or save them to your computer for your future reference.

We amend these terms and conditions from time to time, you can find the most up-to-update version on the Website. These terms and conditions were most recently updated in July 2016.

These terms and conditions are only in the English language.

Capitalised terms in these terms and conditions have the meaning set out in the Glossary at the end of these terms and conditions.

References to "we" and "us" are to Bridaloop Limited and references to "you" are to Buyers and/or Sellers, as the context dictates.

  2. We operate the Website. We are Bridaloop Limited, a company registered in England and Wales under company number 09865934 and with our registered office at 340 Chester Road, WS9 OPP.

  5. The Bridaloop Service
    1. The Bridaloop Service allows you to buy and sell pre-loved wedding dresses online.
    2. Bridaloop is an online marketplace which matches Sellers who are looking to sell a previously worn wedding dress with Buyers who are looking to purchase wedding dresses at a discount to their original price.
    3. We do not stock any of the dresses listed on the Website, our role is simple to connect Buyers with Sellers. Once a Buyer purchases a dress the Seller is responsible for sending the dress to the Buyer in accordance with delivery arrangements agreed with the Buyer.
  6. Using Bridaloop as a Buyer
    1. Registering with Bridaloop as a Buyer enables you to:
      1. view dresses available for sale in the Bridaloop marketplace
      2. contact Sellers via our secure messaging system; and
      3. use our Dressing RoomTM feature.
    2. By accessing and using the Website you agree to:
      1. comply with these terms and conditions;
      2. be respectful in all your communications with our Sellers; and
      3. pay for dresses that you have agreed to purchase.

      How to use the Website

    3. In order to search for a dress you should access the Bridaloop marketplace using the menu button at the top of any page on the Website.
    4. You can search for dresses by style, size, designer, fabric, colour and condition. Click on a particular dress in the search results in order to view details about the dress in the Seller's dress profile.
    5. You can send dresses to your private Dressing Room by clicking on "send to dressing room" in the dress profile. Please see sections 4.14 to 4.17 below for guidance on using your Dressing Room.
    6. If you have any questions about a dress you can select the "ask seller" option in the dress profile. This allows you to complete an online enquiry form with a message to the Seller. The Seller's response will be sent directly to the email address which you note on the online query form.
    7. You are responsible for ensuring that you are satisfied with the authenticity of any dress you are considering buying with special attention to defects. If necessary ask the Seller more questions.
    8. You should report any suspicious activity or items which you think lack authenticity to us using the Contact Methods.
    9. If, having satisfied yourself as to the authenticity and condition of the dress, you would like to purchase the dress from the Seller at the price advertised by the Seller, you should click on the "buy this dress" button in the dress profile. Please note that you will have to be registered on the Website as a Buyer in order to make a purchase. You can register by selecting Option 3 in the registration page or following the registration instructions in the Dressing Room.
    10. You should make sure that you are happy with the delivery method and timeframes advertised by the Seller. Please contact the Seller using the "ask seller" function before making a purchase if you would like to discuss and agree alternative delivery arrangements.
    11. Payment for a dress via the Website is through PayPal. In the interests of security, we strongly advise that you resist any attempts by a Seller to draw you into an offline transaction, as we cannot assist in any disputes arising from transactions conducted in this manner. We also advise that you report to us using the Contact Methods, any such attempt by a Seller to take a transaction offline prior to your purchase.
    12. Where a Seller has made a paid listing, payment will be made directly to the Seller. We strongly advice that you pay via PayPal to benefit from the PayPal payment protection guarantee.
    13. The Dressing RoomTM

    14. The Dressing Room is a unique feature of the Website which allows you to interact with your trusted friends in selecting a dress to purchase.
    15. When you click to send a dress to your Dressing Room, your dress will be saved in your private Dressing Room area for you to view later. You can send up to six dresses to your Dressing Room.
    16. If you would like to grant friends secure access to your Dressing Room in order for them to view the dresses you have narrowed your choice down to, you can provide email addresses of those friends and we will send emails inviting them to your Dressing Room.
    17. We will only use the email addresses that you supply for the purpose of inviting your chosen friends to view the dresses in your Dressing Room.
    18. Placing an order

    19. Instructions on the Website will guide you through the steps you need to take to register as a Buyer in order to purchase a dress.
    20. When you select the 'buy this dress' button on a dress profile you will be redirected to the checkout page where you can choose to either log in to your PayPal account in order to process your payment (this is our recommended method of payment) or input your credit or debit card details in order to pay by card.
    21. Before making any payments please make sure that you have agreed and are happy with the delivery method.
    22. Once your payment has been successfully processed, we will release your contact details (email address) to the Seller and provide you with the Seller's contact details so that you and the Seller can finalise delivery details and discuss any post-sale matters. You consent to us releasing your contact details to a Seller you have purchased a dress from in this way. Please let us know, using the Contact Details, if you change any of your contact details after registering on the Website.
    23. In the interest of security, offline transactions are discouraged as we cannot assist in any disputes arising from purchases conducted in this manner.
    24. Dealing with disputes

    25. If you are unhappy with your purchase you should raise your dissatisfaction with the Seller you purchased your dress from in the first instance. You should do this within seven days of payment of the dress.
    26. Bridaloop will assist you in disputes arising when the dress does not match its description on the Website or is in a worse condition than described, provided that you raise your concerns with the Seller within 7 days of the purchase and the Seller has failed to resolve the dispute to your satisfaction.
    27. You acknowledge that our role is simply to facilitate satisfactory resolution of any disputes and we cannot oblige either party to a dispute to act or refrain from acting in any certain way.
  7. Using Bridaloop as a Seller
    1. You can register as a Seller by choosing one of the two listing options in our registration page and following the instructions for setting up a dress profile.
    2. In registering as a Seller on the Website and listing a dress on the Website, you warrant and represent that:
      1. you are aged 18 or over;
      2. you own the dress (or have the owners express consent to list the dress) and can produce a valid receipt of its purchase if requested to do so by us;
      3. the descriptions of the dress in your profile is accurate and not misleading; and
      4. the condition of the dress is as stated in your profile.
    3. Subject to clause 5.4 below, you must deliver a dress which has been purchased in accordance with the delivery arrangements advertised in your dress profile.
    4. If you agree alternative delivery arrangements to that advertised in your dress profile then you must deliver the dress in accordance with the new arrangements
    5. We recommend that you arrange for delivery by courier or secure post.
    6. Listing your dress

    7. By listing your dress on the Website you agree to:
      1. the display of your dress and its details on our Website; and
      2. us displaying your dress profile or photos and/or information from your dress profile on our social media accounts (including, without limitation, Facebook, Twitter and Instagram).
    8. You must give a truthful description of the dress with specific mention of stains, defects or alterations which may impact the value of the dress.
    9. You acknowledge that you may receive email enquiries from Buyers regarding your dress. Such enquiries will be delivered, via our secure messaging system, to the email address which you provide when setting up your profile. Only registered Buyers will have access to contacting you via our secure messaging system.
    10. Any images uploaded should be photographs of the actual dress for sale. Where an image of the actual dress is not available, you must make it clear in your dress description that the images are not of the actual dress.
    11. If a Buyer requests a viewing of your dress and you are in a position to enable this, we strongly advice that you only meet the Buyer at a public location in the presence of a third party.
    12. We advice against direct exchange of cash or payment via Western union, Moneygram or similar payment method as such transactions are often not traceable in the event of a dispute
    13. You understand that Bridaloop does not take receipt of or serve as a holding depot for any dresses. The Website serves as a marketplace for Buyers and Sellers and you will be required to deliver your dress directly to a Buyer who has purchased it.
    14. Our listing fees

    15. You have two options for paying our listing fees:
      1. Option 1 - list your dress for six months for free and only pay commission if your dress sells. Our commission is 5% of the sale price. If you dress does not sell within the six months period you can re-list it for periods of six months, only paying commission if your dress sells. We will notify you by email when your free listing period expires.
      2. Option 2 - pay a one-off listing fee and list your dress for an unlimited period. The listing fee payable depends on the price you list your dress for:
        1. less than £1,000 - £15
        2. £1000 to £2,000 - £20
        3. £2,001 to £3,000 - £25
        4. more than £3,001 - £30
    16. If you choose to list your dress under Option 1 and your dress sells, we will deduct our 5% commission (together with the merchant fee, if applicable) from the payment made by the Buyer before sending the balance to you.
    17. Transacting with Buyers

    18. Once a Buyer has purchased a dress from you, we will release your contact details (email address) to the Buyer and provide you with the Buyer's contact details so that you and the Buyer can finalise delivery details and discuss any post-sale matters. You consent to us releasing your contact details to a Buyer who has purchased a dress from you. Please let us know, using the Contact Details, if you change any of your contact details after registering on the Website.
    19. Where a paid listing under Option 2 is your method of sale (see section 5.13 above), Bridaloop strongly advices that payment is accepted only via PayPal to benefit from payment protection. If the Buyer pays via PayPal then payment from the Buyer (minus PayPal's merchant fee) will be sent directly to you.
    20. Where a free listing under Option 1 is your method of sale (see section 5.13 above), Bridaloop will receive payment for the transaction on your behalf and hold this for a period of 7 working days. If no dispute is raised in this time, our 5% commission and Paypal's merchant fees will be deducted and the balance paid to you via PayPal.
    21. Bridaloop strongly advices recorded delivery as method of sending your dress as this will support your case in any dispute. If you and the Buyer agree to deliver the dress in person we strongly advice that you only meet at a public location in the presence of a third party.
    22. In the interest of security, offline transactions are discouraged in as we cannot assist in any disputes arising from sales conducted in this manner.

    Post-sale

    If you wish to deactivate your profile once you have sold your dress then please contact us at admin@bridaloop.com to request this. Your profile will not automatically deactivate after you have sold your dress.

  11. We only use your personal information in accordance with our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you.

    1. These terms and conditions, our Privacy Policy and our Terms of Website Use constitute the entire agreement (the "Contract") between you and us and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
    2. You acknowledge that in entering into this Contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these terms and conditions, our Privacy Policy or our Website User Terms.
    3. You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Contract.
  12. Our right to vary these terms and conditions
    1. We amend these terms and conditions from time to time. Please look at the top of this page to see when these terms and conditions were last updated. We will post our updated terms and conditions on the Website. If you are not happy to be bound by any changes to our terms and conditions please do not use the Website
    2. We may revise these terms and conditions as they apply to your use of the Website from time to time to reflect the following circumstances:
      1. changes in relevant laws and regulatory requirements; and/or
      2. changes to our service offering,
  13. Our liability
    1. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.
    2. We reserve the right to suspend or terminate your profile or access to the Website (or any part of it) or remove any content within the Website, for any reason. We will not be liable to you or any third party for any termination of your access to the Website.
    3. We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any liabilities that cannot be excluded by law.
    4. We supply the Website for private use only. You agree not to use the Website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  14. Communications between us
    1. When we refer, in these terms and conditions, to "in writing", this will include e-mail.
    2. You may contact using the Contact Methods set out in section 2.
  15. Other important terms
    1. We try to ensure that the Website is available for your use at all times. However, at times, for reasons beyond our control, the Website may be unavailable or there may be delays and/or disruptions to the service which we provide to your under these terms and conditions. If any such delays or disruptions arise we will do our best to resume services as soon as possible.
    2. We reserve the right to withdraw any part of the Bridaloop Service for any reason.
    3. You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. Please immediately notify Bridaloop of any unauthorised use of your password or account or any other breach of security.
    4. We will deactivate any profiles or accounts which remain inactive for more than two years. If we deactivate your profile or account, we will notify you of such deactivation by email to the email address which you registered with us.
    5. Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
    6. If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
    7. These terms and conditions are governed by English law. This means the use of the Website and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
  16. Glossary
  17. Buyer means a natural person who accesses and uses the Website in accordance with section 4 above and/or a natural person who registers to use the Dressing RoomTM.
    Bridaloop Service means the service which we provide to you under these terms and conditions from time to time and which include the Website and The Dressing RoomTM.
    Contact Methods means the methods of contacting us set out in section 2.1.
    Seller means a natural person who registers to become a Seller in accordance with section 5.
    The Dressing Room means the feature of the Website which enables you and your friends to view dresses in your own private online viewing area (as described in sections 4.14 to 4.17)
